TERMS AND CONDITIONS

Last updated: 30/08/2025]

These Terms and Conditions (“Terms”) govern the use of the services provided by SEND the Help! (“we”, “our”, or “us”). By engaging with our services, you (“you”, “the client”) agree to the following:

1. Nature of Service

  • SEND the Help! provides advice, guidance, and support in navigating Special Educational Needs and Disabilities (SEND) processes, including Education, Health and Care Plans (EHCPs), school placements, appeals, and related matters.

  • Our service is not legal representation. While our team holds recognised certification in SEN Law (IPSEA Levels 2 & 3), we are not qualified solicitors or barristers.

  • We provide support based on training, experience, and lived expertise, but we cannot act as your legal representative in court or tribunal.

2. No Guarantee of Outcomes

  • We will make every reasonable effort to provide accurate, supportive, and informed advice.

  • However, we do not guarantee any particular outcome from applications, requests, or appeals. The final decision always rests with third parties such as schools, Local Authorities, health providers, or the SEND Tribunal.

  • You acknowledge that the success of any application, appeal, or request depends on multiple factors outside of our control.

3. Client Responsibility

  • All decisions and actions taken following our advice are your own responsibility.

  • You are responsible for providing accurate and complete information when seeking our support.

  • You are responsible for meeting all deadlines, providing necessary documentation, and ensuring compliance with Local Authority or tribunal requirements.

4. Limitation of Liability

  • To the maximum extent permitted by law, SEND the Help! will not be held liable for:

    • Any loss, damage, or disappointment resulting from outcomes of requests, applications, or appeals.

    • Any reliance placed solely on our guidance without independent verification.

    • Any indirect or consequential loss.

  • Our liability for any claim shall in all cases be limited to the fees paid by you for the service in question.

5. No Legal Advice

  • The support provided should not be considered as a substitute for independent legal advice.

  • Where legal representation is required (for example, at a Tribunal), we recommend seeking assistance from a qualified solicitor, barrister, or specialist legal professional.

6. Payments & Refunds

  • Fees for services are as agreed at the time of booking.

  • Refunds will only be issued at our discretion and will not apply where services have already been provided.

7. Confidentiality

  • We respect your privacy and handle your information in accordance with our Privacy Policy.

8. Governing Law

  • These Terms shall be governed by and construed in accordance with the laws of England and Wales.

  • Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
